Terms of Use

1. Acceptance of Terms

By downloading, installing, or using SKAPPR ("the Application" or "the Service"), you accept and agree to be bound by the terms and provisions of this End-User License Agreement ("EULA"). This EULA is concluded between you ("End-User") and SKAPPR, not with Apple Inc. ("Apple"). If you do not agree to these terms, please do not download, install, or use the Application.

2. Apple Requirements and Third-Party Beneficiary

You acknowledge that this EULA is concluded between you and SKAPPR only, and not with Apple. SKAPPR, not Apple, is solely responsible for the Application and its content.

Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

This EULA does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.

3. License Scope

The license granted to you for the Application is limited to a non-transferable license to use the Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

The Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

4. Description of Service

SKAPPR is an AI-powered mobile application creation platform that allows users to generate mobile applications through natural language prompts. The service is provided on a token-based pricing model.

5. Maintenance and Support

SKAPPR is solely responsible for providing any maintenance and support services with respect to the Application, as specified in this EULA, or as required under applicable law.

You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

6. Warranty

SKAPPR is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.

Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be SKAPPR's sole responsibility.

7. Product Claims

You acknowledge that SKAPPR, not Apple, is responsible for addressing any claims relating to the Application or your possession and/or use of the Application, including but not limited to:

• Product liability claims
• Any claim that the Application fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection, privacy, or similar legislation

This EULA does not limit SKAPPR's liability to you beyond what is permitted by applicable law.

8. Intellectual Property Rights

You acknowledge that, in the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, SKAPPR, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

9. Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
• You are not listed on any U.S. Government list of prohibited or restricted parties

10. User Accounts

To use our service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 13 years old (or the minimum age in your jurisdiction)
• Be responsible for all activities that occur under your account

11. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Application. For example, if you have a VoIP application, you must not be in violation of your wireless data service agreement when using the Application.

12. Acceptable Use

You agree not to use the service to:

• Create applications that violate any laws or regulations
• Generate content that is harmful, offensive, or inappropriate
• Infringe on intellectual property rights of others
• Distribute malware, viruses, or other malicious code
• Attempt to reverse engineer or hack our systems
• Use the service for any fraudulent or deceptive purposes

13. Token System and Payments

• Our service operates on a token-based system
• Tokens are consumed when generating or modifying applications
• All purchases are final and non-refundable
• Token prices may change with notice
• Unused tokens do not expire but may be subject to account deletion policies

14. Intellectual Property

Your Content: You retain ownership of the applications you create using our service, subject to our right to use your prompts and generated content to improve our AI models.

Our Content: The SKAPPR platform, including but not limited to software, algorithms, and user interface, is owned by us and protected by intellectual property laws.

15. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices. By using the Application, you consent to the collection and use of data as described in our Privacy Policy.

16. In-App Purchases and Subscriptions

If the Application offers in-app purchases or subscriptions:

• All transactions are processed through Apple's App Store
• Payment will be charged to your Apple Account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple Account settings
• Refunds are handled according to Apple's refund policy

17. Service Availability

We strive to keep our service available 24/7, but we do not guarantee uninterrupted access. We may suspend or discontinue the service at any time with or without notice.

18. Limitation of Liability

SKAPPR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

19. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, and hereby disclaim all warranties including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

20. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Application will cease immediately.

21. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising under these Terms will be resolved through binding arbitration.

22. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. Continued use of the Application after changes constitutes acceptance of the new Terms.
